Terms
and Conditions
General
Nothing in these conditions shall affect the statutory rights of
any consumer.
All orders are accepted and goods supplied subject to the following
express terms and conditions:-
These conditions may not be modified or varied unless Truckfix Motorsport
(hereinafter referred to as “Truckfix”) agrees in writing,
and Truckfix shall not be deemed to accept such other conditions
nor waive any of these conditions by failing to object to provisions
contained in any purchase order or any other communication from
the buyer. No person has any authority on behalf of Truckfix to
vary any conditions except Mrs Janine C Simons and only in writing
signed by her on Truckfix official notepaper.
GoPeds-online, and GoPeds-online.co.uk are trading styles of Truckfix
Motorsport and hereinafter are included in any reference to “Truckfix”.
No binding contracts shall be created until the Truckfix has indicated
its acceptance of an order in writing or by making delivery or part
delivery of the goods.
Terms and conditions are subject to change without notice, E.&
O. E.
Images on the site are a good representation of the products, however
100% accuracy cannot be guaranteed.
Delivery
For all products please allow 14 days for delivery
Delivery dates and times are given in good faith by Truckfix to
indicate estimated delivery times but shall not amount to any contractual
obligation to deliver at the time stated and is subject to payment
clearance, locality, human error, courier company error and system
failure.
Truckfix will accept no liability for direct or consequential loss
or damage arising from delay in delivery of goods.
In the event that ordered goods are out of stock in the UK Truckfix,
will advise the customer of the estimated delivery date, if the
estimated delivery date is more than 28 days the customer will have
the right to cancel the order and receive a full refund of any monies
paid.
Delivery costs are as detailed on the On-Line Payment System and
within the frequently asked questions section of the internet sites.
All Delivery prices relate to UK mainland only and extra charges
will apply to all other delivery locations.
In the event that goods are lost or damaged in transit , Truckfix
will only accept liability limited to that payable by the courier
under the delivery option chosen by the customer.
Payments
Payments are accepted by:
Credit /Debit Cards(via our On-Line Secure Payment System or by
telephone)
Cheque, P.O’s, M.O’s and Bank Transfers.
All goods must be paid for in full before we supply them
All prices include all UK Taxes
All cheques and Postal Orders must be made payable to Truckfix
Motorsport for any goods, services and charges due to Truckfix
Prices
All prices are subject to change without notice and subject to
a delivery charge specified at the time of ordering. Unless otherwise
agreed in writing, all orders are executed subject to prices ruling
at the date of dispatch and no price list of Truckfix, whether published
or not, shall affect the right of Truckfix to charge for the goods
in accordance with this clause.
The customer will be advised of the total price of the order before
delivery and if there has been a price change or price correction
the customer will be given the option to cancel their order and
receive a refund of any monies paid in connection with the order.
Any clerical or error or omission in any sales literature, quotation,
price list (including any internet sites), acceptance of offer or
information issued by Truckfix shall be subject to correction without
liability on the part of Truckfix.
Extra Costs
In the event of any variation or suspension of orders through the
customers instructions or lack thereof, prices may be increased
to cover any extra expenses thereby incurred by Truckfix.
Credit Card Internet/telephone Orders
In the case of goods purchased by credit card where the card holder
does not attend the Truckfix offices, those goods can only be delivered
to the cardholders registered address only. This is an anti-fraud
measure to protect both you the card holder and Truckfix from fraudulent
use of credit cards.
Truckfix adopts procedures to protect and keep safe your credit
card information. Once a transaction is completed details of your
credit card are destroyed. The only information held on file for
audit and security purposes are address details and authorisation
codes.
Personal Data
Your personal data , being address and telephone numbers, is kept
on file for our own and accounting purposes. Truckfix does not share
this personal information with any third party nor does it sell
or pass this data to any third party marketing organisations.
Statutory Cancellation Period
The Consumer Protection (Distance Selling) Regulations 2000 provide
the customer with the option to cancel up to the seventh day following
receipt of the goods.
Truckfix must be notified in writing that the order is to be cancelled
and provide a reasonable explanation as to the reason.
All goods to be returned must be in the original packaging and
not used. In the case of machines these must not have had the engine
started or fuel placed in the fuel tank.
The consumer will be responsible for the safe return of the goods
to our offices and pay all costs in connection with the safe return.
In circumstances where Truckfix has spent considerable effort in
satisfying an order specifically for a customer, Truckfix may decide
at its discretion not to allow cancellation of such an order.
The cost of any delivery option other than provided by Truckfix
free of charge will not be refunded under these circumstances.
Ownership of Goods
Truckfix and the customer agree that until Truckfix has received
a confirmed cleared payment in full for the goods supplied or to
be supplied the title in the goods remains with Truckfix.
It is further agreed that until payment is received as referred
to above any goods delivered to a customer will be held as bailee
and the customer will be fully accountable to truckfix for those
goods.
It is further agreed that as bailor of the goods, Truckfix by way
of an appointed agent shall (without prejudice to the customers
continuing fiduciary obligations) be entitiled to enter upon land,
buildings or vehicles where the goods have been delivered or reasonably
thought to be situated, to retake possession.
Shortages, Damange and Loss in Transit
Any shortages or damaged goods should be notified to us Within
24 hours of receipt. All packaging and contents must be held for
inspection. Any damaged packaging must be noted and signed for accordingly
from the carrier. The customer will always be allowed reasonable
time to inspect the goods supplied to ensure the goods comply with
“The Sale of Goods Act”.
Compatibility of Goods
Customers are responsible for verifying the suitability and compatibility
of parts and equipment before purchasing, Truckfix does not supply
any goods on a trial basis.
Truckfix does not warrant the suitability and compatibility of
goods for specific applications other than that specifically specified
on the website.
Truckfix does not warrant the suitability of any goods supplied
to be fitted to non GoPed equipment.
Returns and Refunds
Any goods returned must be accompanied with a valid invoice or
receipt, Truckfix accepts no responsibility for any goods returned
without the appropriate invoice.
All goods returned due to being unsuitable will incur a restocking
administration charge of £10.00 or 30% of invoice total, whichever
is the greatest. This does not apply to any goods specially ordered
for the customer.
Faulty goods found to be in good order will incur a testing and
administration charge of £10.00 or 10% of invoice total, whichever
is the greatest in addition to the cost of postage and package back
to the customer.
If any customer wants to return any goods we request that these
goods remain unopened, in the original packaging and undamaged.
In the case of machines these must not be run or any fuel put in
the petrol tanks.
Truckfix will not accept any goods back for return if they have
been used. If the original packaging is not returned an additional
charge may be levied to cover the cost of providing new packaging.
Truckfix would suggest that all goods being returned to our offices
should be sent by recorded or special delivery as the customer is
responsible for those goods until safe receipt by Truckfix. The
cost of return delivery and insurance is the sole responsibility
of the customer.
Consequential Losses
Truckfix’s liability will be limited to the invoice cost
of the goods supplied only and not for any consequential damages
or losses howsoever caused.
Further Truckfix shall not be responsible for any damage or injury
caused to the customer, by any goods supplied by Truckfix. It is
the customers responsibility to ensure that the items purchased
are compatible with any other of the customers goods and used only
in the way intended.
The customer is responsible for ensuring that the goods are only
used in conjunction with the appropriate safety gear.
Force Majeure
Truckfix shall not be liable for any delay in or failure to perform
any of its obligations hereunder if the delay or failure is due
to causes outside the reasonable control of Truckfix, ie. acts of
god, riots floods, earthquake, war or civil commotion.
